Terms of Service 

Welcome to Counting Kiwis. These terms and conditions outline the rules and regulations for using our services. By engaging with our services, you accept these terms and conditions in full: 

Counting Kiwis (NZBN 9429052262609) is the trading name of Emily Hawker. In these Terms of Service, 'we,' 'us,' and 'our' refer to Counting Kiwis

The term "Client" refers to any individual or entity engaging Counting Kiwis for services as described in these Terms of Service. 

The term “Person” – includes any natural person, corporation, partnership, body corporate, association or group, and any other entity, or any other association of persons either corporate or unincorporated. 

General 

  • The Client agrees to follow safe sleep practices in line with SIDS recommendations. Please click here to read more.

  • The Client understands the safety guidelines on co-sleeping and accepts that Counting Kiwis adheres to safe sleeping practices, which support room-sharing but not bed-sharing.

  • The Client will disclose any medical conditions their child has to Counting Kiwis.

  • The Client will not disclose any information received from Counting Kiwis to a third party without our prior permission. 

  • Counting Kiwis will be available Monday to Friday. The 14-day support period includes weekends, but no support will be provided on these days, though feedback on weekend logs will be given. 

  • All materials, guides, and resources provided by Counting Kiwis remain our intellectual property and are for the Client's personal use only. Reproduction or distribution of these materials without permission is prohibited. 

Payment 

  • Full payment for all packages and follow-up support is required before the consultation starts. Once payment is received, the Client will receive an acknowledgment from Counting Kiwis. Phone consultations will be confirmed once payment has been received. 

  • Counting Kiwis reserves the right to alter prices at any time for any reason. 

  • A sleep plan or consultation will not be issued if there are outstanding payments. Counting Kiwis reserves the right to cancel a consultation if there is an outstanding balance at the time of the scheduled appointment. 

  • Any outstanding debt to Counting Kiwis will be referred to debt collection agencies.

  • Payment must be made in full via our website.

  • Refunds will not be offered if the Client is dissatisfied with the results. 

Client Acknowledgement 

  • The information provided in the sleep intake questionnaire is accurate to the best of the Client’s knowledge.

  • If the Client’s child has a medical condition, approval from a healthcare provider has been obtained before starting a sleep plan. 

  • The Client acknowledges it is their responsibility to rule out any medical causes of sleep problems (such as sleep apnea) as a child with underlying medical conditions may not be suitable for a sleep plan. 

  • The Client acknowledges it is their responsibility to ensure their child is gaining weight  appropriately, thriving, and otherwise well before starting a sleep plan. 

  • The Client acknowledges that Counting Kiwis does not provide medical advice. Any concerns regarding the child’s health should be addressed with a healthcare provider. A sleep plan from Counting Kiwis is not a substitute for medical advice. 

  • The Client acknowledges that Counting Kiwis will not be liable for any injuries or adverse events occurring while undertaking a sleep plan. The Client is responsible for their child's safety and health at all times. 

  • Screenshots of communication and information regarding the child's sleep improvements and milestones may be used for marketing purposes, with names and identifying features removed unless permission is granted. 

Counting Kiwis Sleep Plan Without Support 

  • This package does not include follow-up support. 

  • Clients may upgrade within 3 months of the phone consultation to purchase 2 weeks of WhatsApp support (Monday-Friday) and sleep and activity log review, subject to availability. 

Counting Kiwis Workshops 

  • A minimum group size of 10 participants is required to book a workshop. 

  • Booking must be confirmed by a non-refundable deposit of 25% of the total fee. The remaining balance is due 48 hours before the workshop. 

  • Pricing is subject to change and will be confirmed in the customised quote provided upon request.

  • Cancellations made more than 14 days before the scheduled workshop will receive a full refund of the deposit. 

  • Cancellations made within 14 days of the workshop will forfeit the deposit. 

  • Rescheduling requests made with at least 7 days' notice will be accommodated based on availability. Additional fees may apply. 

  • The person is responsible for securing the venue for the workshop unless otherwise agreed upon.

  • If the workshop is held at a location other than the person’s premises, additional travel charges may apply. 

  • The venue should be equipped with necessary facilities including seating and presentation equipment.  

  • Workshop topics and content are designed to address general sleep-related issues. Specific topics can be customised based on prior agreement. 

  • The workshop is educational and advisory in nature. Participants should consult their healthcare provider for medical advice. 

  • The person is responsible for ensuring that the minimum group size is met and that participants are informed of the workshop details. 

  • All advice and information provided during the workshop are intended for educational purposes only and should not replace professional medical advice. 

  • Any personal information collected during the workshop will be kept confidential and used solely for the purpose of providing the service.

  • Resources provided are exclusively for workshop attendees and are not intended for distribution to third parties.  

  • By booking a workshop, the person and participants agree to adhere to these terms and conditions. 

Cancellations 

  • Cancellations made more than 15 working days before a consultation will receive a full refund, minus transaction fees. 

  • Cancellations made less than 15 working days before a consultation are not eligible for a refund.

  • In cases of illness or critical events, Counting Kiwis can reschedule the consultation and accommodate accordingly. 

  • Once the sleep plan has been received or a consultation has occurred, no refunds will be offered  for a change of mind. 

  • If a support package is postponed for reasons agreed upon by the Client and Counting Kiwis, the Client forfeits eligibility for a refund from the rescheduled support start date (unless due to medical reasons). 

  • If a support package is cancelled due to medical reasons and the Client has received the sleep plan, the support will be postponed to a date agreed upon by both parties. 

  • Counting Kiwis reserves the right to cancel any package before the commencement of the home or phone consultation if deemed inappropriate for the Client. An alternative package may be suggested, and the price difference refunded, or the full amount refunded if Counting Kiwis or the Client chooses to forfeit the service. 

  • Families may resume their Kiwi Dream Team package within 3 months of cancelling the initial booking. No refunds will be provided (subject to availability). 

  • You may reschedule your consultation once without additional fees, provided the request is made more than 7 working days in advance. Rescheduling requests made within 7 working days of the  scheduled start date may be subject to availability and an additional fee. 

Conditions of a Sleep Plan 

  • Individual results may vary based on factors such as consistency, commitment, personal matters, approach to technique, child’s needs, age, severity of the situation, correct plan adherence, communication with Counting Kiwis, and parental desire for change. 

  • Counting Kiwis is committed to staying current with information, research, and knowledge about child sleep. 

  • The customised sleep plan is intended for the Client's child only and should not be shared with third parties. The information may not be suitable for another child. 

  • Any changes the Client makes to their child's sleep or eating arrangements are their  responsibility. Counting Kiwis will only make suggestions for change, which the Client is responsible for implementing. 

  • It is the Client's responsibility to contact Counting Kiwis for follow-up and to send sleep log information for feedback as frequently as suggested. 

  • The sleep plan is tailored for the Client's child and family and should not be shared. Anyone found sharing sleep plans or guides will be liable for the cost of the materials. 

  • Follow-up support must be used for 14 consecutive days, with the possibility of pausing due to illness or emergency, subject to agreement. Support must commence within 30 days of resuming. By purchasing a sleep package, the Client agrees to these terms and conditions and the privacy  policy as outlined.

  • All communication during the consultation period will be conducted through agreed-upon channels (e.g., email, WhatsApp, phone, or video calls). Clients should ensure they are available and responsive to facilitate the consultation process. If Counting Kiwis does not hear from the Client, it will be assumed that everything is proceeding well and no additional support is needed.

  • Counting Kiwis is fully covered by IICT insurance. 

  • Any changes to your baby's sleep or eating arrangements suggested by Counting Kiwis are at your discretion and responsibility. 

  • The information provided on this website or by Counting Kiwis is not intended to replace professional medical advice. Always seek the advice of a GP or qualified healthcare provider regarding the medical condition or health of your baby, toddler, or child. 

  • Counting Kiwis makes every effort to provide up-to-date and accurate information during consultations and on this website but does not guarantee the completeness of the information provided. 

  • Counting Kiwis is not liable for any loss or damages (including direct or indirect loss, or special or consequential loss) resulting from access to, or inability to access, this website, or from reliance on any information provided on this website or by the consultant.

Changes to Terms of Service 

Counting Kiwis reserves the right to update or modify these Terms of Service at any time without prior notice. Your continued use of our services constitutes acceptance of the revised terms.
